Despite the existence of the principle of procedural congruence that imposes the court to rule within the boundaries of the claims filed by the parties and the grounds that support the appeal and its opposition, effective judicial protection also obligates the same judicial body to analyze ex officio and rule on the eventual expiration of the sanctioning procedure, without it being an impediment that the parties have not previously alleged the eventual time lapsing or expiration of the procedure.
